The Law No. 9609 dated of February 19, 1998 referring to software intellectual property, defines itself as:

Art. 1 - Computer program is the expression of an organized set of instructions arranged in a common or codified language, comprising a material device from any substantial source, for use in automatic hardware for data processing, materials, instruments or peripheral equipments based on digital or analogue technique , set to function in a way for special purposes.
Computer programs, also known as software dealing with an intellectual work are protected in Brazil by the Law No. 9610 of February 19, 1998, Article 7th , XII.

It is up to the Brazilian Patent and Trademark Office – INPI – the registration of this kind of creativity .

The software property rights validity will be 50 years as of the 1st day of the following year as of the date of its making.
